Privacy Policy

1. About this Privacy Policy 

1.1 English with Jumping Jinx, ABN 18743891399 has implemented this Privacy Policy to provide information about what kinds of Personal Information we may collect or hold, how we collect, hold, use and disclose that Personal Information, choices you have regarding our use of that Personal Information, and your ability to access or correct that Personal Information. If you wish to make any inquiries regarding this Privacy Policy, you should contact our Managing Director in any of the ways specified in paragraph 17. 
 
1.2 From time to time, English with Jumping Jinx may be related to other companies and entities (related entities). This Privacy Policy applies to the use of your Personal Information by us and by those related entities. Those related entities may also have their own privacy policies which set out additional detail or differences in their privacy practices. To the extent that those privacy policies are inconsistent with this Privacy Policy, those privacy policies will prevail over this Privacy Policy in relation to the actions of those related entities. A reference in this Privacy Policy to  English with Jumping Jinx, we, us or our is also a reference to those related entities. 

1.3 English with Jumping Jinx’s Privacy Management Program 

English with Jumping Jinx has implemented a Privacy Management Program to support the open and transparent management of personal information. This program includes internal policies and procedures designed to ensure compliance with the Australian Privacy Principles (APPs), regular reviews and audits of our privacy practices, staff training, and governance measures such as privacy impact assessments for new projects. English with Jumping Jinx’s Managing Director oversees the program for privacy risks, actions and improvements. 

2. Personal Information
 
2.1 "Personal Information" is information or an opinion, whether true or not, and whether recorded in a material form or not, about an identified individual or an individual who is reasonably identifiable. 

2.2 Anonymity and Pseudonymity 

English with Jumping Jinx does not offer services on an anonymous or pseudonymous basis, as it is not practicable for us to do so. As an education service provider delivering tutoring and child-focused learning programs, English with Jumping Jinx must collect identifiable information to: 

  • match students with appropriate tutors,

  • ensure compliance with child protection and safety laws,

  • communicate effectively with parents and guardians,

  • maintain accurate learning records, and

  • deliver services in a safe, personalised and accountable manner. 

Under the Australian Privacy Principles (APP 2), organisations are not required to offer anonymity or pseudonymity where it is impracticable. For the reasons above, English with Jumping Jinx is exempt from this requirement in the context of its service delivery. 

3. What Personal Information do we collect and hold? 
 
3.1 The types of Personal Information we may collect about an individual will depend upon the nature of our interaction with them. Personal Information that we collect may include the following: 


 Customer/Student: 

  • first name and surname initial

  • age

  • emergency phone number of parent/guardian  

  • e-mail address/es 

  • school year level 

  • country, postcode, time zone

  • photographs, video interviews, call recordings, class recordings and/or images of you from camera footage (for example, of an online tutoring class)

  • payment details, such as credit card information or bank account details (collected and passed to English with Jumping Jinx’s PCI compliant payment partner/s for processing payments). English with Jumping Jinx does not hold payment card details. 

  • lessons, video footage and voices recorded for marketing (with parents/guardians written permission only)

 
We collect and record Personal Information about individuals, such as: 

  • our students, potential students and their parents or guardians 

  • our suppliers and potential suppliers and their representatives, directors, partners, proprietors and shareholders  

  • contractors and subcontractors and potential contractors and subcontractors and their representatives in relation to providing goods and services to us 

  • any other person who comes into contact with English with Jumping Jinx. 


4. How and when do we collect Personal Information? 
 
4.1 We collect your Personal Information to allow us to conduct our business functions, to provide, market and sell our products and services and for the specified purposes set out in paragraph 6. In some circumstances, the collection of Personal Information may be required by law. 
 
4.2 We may collect your Personal Information in the course of providing you with goods or services: 

  • when you use or buy our products or services 

  •  when you provide us, or you offer or apply to supply us, with goods or services 

  • when you provide information to us in any way (including by completing a form, disclosing information over the phone, via email, by post or providing us a business card) 

  • when you request information about us, our products or our services 

  • when you provide feedback to us 
    when you visit or fill in a form on our Website (see paragraph 5) 

  • when you attend a tutoring or learning class or correspond generally with a tutor 

  • when you (or an authorised third party) provide that information to us in the course of conducting or administering our relationship with you, or when you are carrying out activities in connection with our business operations

  • when you submit a job application to us 

  • when you otherwise contact us by telephone, email, social media, post, via interactions with anyone at English with Jumping Jinx
    where we are otherwise required or authorised by law to do so when students interact with English with Jumping Jinx 

4.3 Generally, when providing our products and services, dealing with our personnel, or obtaining goods and services from our service providers, suppliers or contractors, we collect Personal Information directly from the relevant individual where reasonable and practicable. 
 
4.4 We may also collect Personal Information about you from third parties and other sources such as: 

  • your nominated representatives (e.g. parent or guardian, spouse, accountant, power of attorney, brokers and other professional advisors) 

  • our share registry service provider 

  • publicly available sources of information, or 

  •  related entities, companies and businesses of English with Jumping Jinx, but we will only collect your Personal Information in this way if it is unreasonable or impracticable to collect this information directly from you or if we are otherwise permitted to do so. 

    4.5 If the Personal Information we collect includes sensitive information, including health and biometric information, we will ask for your consent to collect sensitive information, unless the law allows us to collect it without your consent. We apply additional safeguards for sensitive information to ensure it is stored and processed securely. Access to sensitive information is restricted to authorised personnel only and is protected using encryption and secure storage methods. This includes any sensitive information a student may voluntarily disclose to us while engaging with us in any form. We encourage users not to submit personal or sensitive data unless necessary. 
     
    4.6 Where we engage with you multiple times over a short period in relation to the same matter, we may not provide you with a separate notice about privacy each time we engage with you. 
     
    4.7 In most cases, if you choose not to provide your Personal Information to us for the purposes set out in this Privacy Policy, or if we do not or are unable to collect the Personal Information we require, we may not be able to provide you with requested information, products or services, or to effectively conduct our relationship with you. 
     
    5. Information collected via our Website 
     
    5.1 Personal Information may be collected by us and by our third party service providers who assist us in operating our Websites including but not limited to English with Jumping
    Jinx.com including their subdomains and any other Website we operate from time to time (collectively the Website). 
     
    5.2 We may use various technological methods from time to time to track the visiting patterns of individuals accessing our Website, including but not limited to the methods set out in this paragraph 5. 
     
    Google Analytics 
     
    5.3 We use Google Analytics to help analyse how you use our Website. Google Analytics generates statistical and other information about Website use by means of cookies, which are stored on users' computers. The information generated is used to create reports about the use of our Website. Google will store this information.

Google Tag Manager 

5.5 Our Website uses Google Tag Manager, a tool that allows us to deploy and manage marketing and analytics tags. Google Tag Manager itself does not collect personal information, but it may activate other tags that collect data as described in this Privacy Policy. 
 
Facebook Pixel 

5.6 We use the Facebook Pixel to measure the effectiveness of our advertising campaigns, understand how users engage with our Website, and optimise our marketing. The Facebook Pixel may collect information such as pages visited, browser and device details, and actions taken on the Website. This information does not identify individuals and is used in accordance with Facebook's data handling practices.

Class recording software 
 
5.13 We may use class recording or behavioural analytics tools from time to time to improve Website performance and diagnose issues. These tools record generic interaction data (e.g., clicks, scrolling) and are not used to identify individuals unless required for customer support. 

Third party content (e.g. social media links) 
 
5.14 Some of the content on our Website may include applications made available by third parties, such as social media buttons or links that allow you to share content or links to our Website through the relevant third party platforms. These third party applications themselves may facilitate collection of information by those third parties, through your interaction with the applications and sometimes even if you do not interact directly with them. 6. How do we use your Personal Information?

  • to develop a personalised tutoring program, learning plan and class for a student

  • to assess and track a student's progress

  • to provide a student with access to a tutoring class recording to otherwise assist customers by providing them with information and support 

  • to collect and process payments 

  • to help us to manage and enhance products or services we provide to you 

  • to help us to manage and enhance goods and services we procure from our suppliers and subcontractors 

  • to help us manage and respond to a general or specific shareholder enquiry 

  • to process share applications and service shareholders' needs 

  • to provide facilities and services a shareholder may request 

  • to carry out appropriate administration in relation to our shareholders and our share registry, including to submit listing applications to, or respond to enquiries from, corporate regulators 

  • to personalise and customise your experiences on our Website

  • to manage and administer any account you may hold with us

6.4 We reserve the right at all times to monitor, review, retain, and/or disclose any information as necessary to satisfy any applicable law, but we have no obligation to monitor the use of the Website or to retain the content of any user or learning class. 
 
6.5 You consent to us using your Personal Information in the above ways and as set out in this Privacy Policy. 
 
6.6 We may otherwise collect, use or disclose your Personal Information where the collection, use or disclosure is: 

  • in accordance with this Privacy Policy or any agreement you enter into with us, or 

  • required or authorised by law, including without limitation the Australian Privacy Principles under the Privacy Act 1988 (Cth). 
     

    7. When do we disclose your Personal Information? 
     
    7.1 English with Jumping Jinx may disclose or provide access to your Personal Information to third parties in connection with the purposes described in paragraph 6. Depending on the circumstances and the nature of your engagement with us, we may disclose your Personal Information to our related entities, to third parties that provide products and services to us or through us, or to other third parties (such as your referee(s) in connection with a job application you have submitted). 
     
    7.2 We may also disclose your Personal Information to: 

  • any of English with Jumping Jinx’s tutors, educators, internal divisions, business units or departments 

  •  your parent or guardian if you are younger than 15 years old in Australia or 13 years old in USA, UK, Europe 

  • your nominated representatives 

  • other organisations or individuals who assist us in providing products and services to you

  • professional service providers and advisors who perform functions on our behalf, such as lawyers 

  • medical providers including medical and rehabilitation practitioners for assessing insurance claims 

  • representatives, agents or contractors who are appointed by us in the ordinary operation of our business to assist us in providing goods or services or administering our business (such as for data storage or processing, printing, mailing, marketing, planning and product or service development)

  • debt collecting agencies 

  • banks, lenders, valuers, insurers, brokers, auditors, business consultants and IT service providers, and 

  • Government, regulatory authorities and other organisations as required or authorised by law. 
     
    7.3 We may also disclose your Personal Information to our Website host or software application providers in certain limited circumstances, for example, when our Website experiences a technical problem or to ensure that it operates in an effective and secure manner. 
     
    7.4 As we continue to develop our business, we may buy, merge or partner with other companies or organisations, and in so doing, acquire customer Personal Information. In such transactions, Personal Information may be among the transferred assets. Similarly, in the event that a portion or substantially all of our business or assets are sold or transferred to a third party, we may also disclose certain information including your Personal Information to a purchaser or potential purchaser in connection with the sale or potential sale of us, our business or any of our assets, including in insolvency. 
     
    8. Data retention and destruction 
     
    8.1 We retain Personal Information only for as long as necessary to fulfil the purposes for which it was collected, or as required by law, including under applicable child protection, education, tax, and corporate recording-keeping obligations. 

8.2 Where personal information is no longer required for the purpose for which it was collected—and retention is not otherwise required by law—we will take reasonable steps to destroy or de-identify the information in a secure manner. 

8.3 We will securely destroy or de-identify Personal Information. Specific retention periods apply based on the type of data: 

  • Customer and Student Data: Retained for seven years after the last interaction to comply with record-keeping obligations. 

  • Employee Data: Retained for a minimum of seven years after employment termination. 

  • Financial Data: Retained as required by taxation and financial reporting obligations, typically for seven years. You may request further information about our data retention practices by contacting our Managing Director using the contact details specified in paragraph 17. 

8.4 Deletion and de-identification processes include secure erasure from systems, removal of personal identifiers from datasets, and the use of secure data destruction tools where appropriate. 
 
9. Overseas disclosures 
 
9.1 We may transfer your Personal Information to entities located outside Australia, including in the United States and other countries where our service providers are located. We take reasonable steps to ensure that these entities comply with privacy obligations similar to those under the Privacy Act 1988. Where this is not feasible, we will obtain your consent before the transfer or ensure the transfer is otherwise consistent with the Privacy Act. 9.1A Some AI-generated responses may be processed by third-party providers located outside Australia. Where applicable, we take reasonable steps to ensure these providers protect personal information in line with the Privacy Act. In some cases, data may be processed in anonymised or de-identified form. 

9.2 Some of your Personal Information may be disclosed, transferred, stored, processed or used overseas by us, or by third party service providers. This may happen if: 

  • our offices or related entities are overseas 

  • we outsource certain activities overseas 

  • transactions, information, services or products have an overseas connection, or our computer systems including IT servers are located overseas. 
     

    9.3 You consent to the collection, use, storage, and processing of your Personal Information outside of Australia as set out in this Privacy Policy. 


9.4 In particular, your Personal Information may be disclosed to third parties in the United States, and such other countries in which those parties or their, or our, computer systems may be located from time to time, where it may be used for the purposes described in this Privacy Policy. In these circumstances, you consent to the collection, use, storage and processing of your Personal Information in those countries, without us being responsible under the Privacy Act 1988 (Cth) for such use (or for any breach). Where such parties are located overseas, you may have rights to enforce such parties' compliance with applicable data protection laws, but you might not have recourse against those parties under the Australian Privacy Act in relation to how those parties treat your personal information. 
 
10. Other uses and disclosures 
 
10.1 We may collect, use and disclose your Personal Information for other purposes not listed in this Privacy Policy. If we do so, we will make it known to you at the time we collect or use your Personal Information. 
 
11. Marketing 
 
11.1 You consent to us using your Personal Information for sending you information, including promotional material, about us or our products and services, as well as the products and services of our related entities and third parties, now and in the future. You also consent to us sending you such information by means of direct mail, telemarketing, email, SMS and MMS messages. 
 
11.2 If you do not want to receive marketing information from us or if you want to stop receiving telemarketing, you can unsubscribe in any of the following ways: 

  • clicking on the 'Unsubscribe' or subscription preferences link in a direct marketing email that you have received from us 

  • logging into your account on the Website or our portal and editing your communication preferences, or 

  • contacting us using the contact details specified in paragraph 17. 
     
    11.3 We will promptly action any opt-out requests from marketing communications, generally within five business days. Where available, you may also request that we limit our marketing to specific channels or types of content by updating your preferences. 
     
    12. Storage and security of Personal Information held by us 
     
    12.1 We aim to keep your Personal Information secure. Any Personal Information that is collected via our Website or which is held on our computer systems is protected by safeguards including physical, technical (firewalls, SSL encryption etc) and procedural methods. 
     
    12.2 If we find that we no longer require or have no further need for your Personal Information we may de-identify it or remove it from our systems and destroy all record of it. 
     
    13. You can access and update your Personal Information 
     
    13.1 You are generally entitled to access Personal Information that we hold about you. If you request access to your Personal Information, in ordinary circumstances we will give you full access to your Personal Information. Depending on the nature of the request, English with Jumping Jinx may charge for providing access to this information, however such charge will not be excessive. However, there may be some legal or administrative reasons to deny access. If we refuse your request to access your Personal Information, we will provide you with reasons for the refusal where we are required by law to give those reasons. 
     
    13.2 A request for access can be made by contacting our Managing Director in any of the ways specified in paragraph 17. 
     
    13.3 We take all reasonable steps to ensure that any Personal Information we collect and use is accurate, complete and up to date. To assist us in this, you need to provide true, accurate, current and complete information about yourself as requested, and properly update the information provided to us to keep it true, accurate, current and complete. 
     
    13.4 Please contact us in any of the ways specified in paragraph 16 if you believe that the Personal Information is inaccurate, incomplete or out of date, and we will use all reasonable efforts to correct the information. 
     
    13.5 It would assist us to ensure we properly understand your request, and allow us to respond more promptly, if requests are made in writing and include as much detail as possible. 
     
    13.6 We aim to respond to all access and correction requests within 30 days. If we need more time, we will notify you of the expected timeframe. If a fee applies for accessing your Personal Information, we will inform you in advance. 
     
    14. How do we deal with complaints about privacy? 
     
    14.1 If you feel that we have not respected your privacy or that we have conducted ourselves inconsistently with this Privacy Policy, please contact our Managing Director in any of the ways specified in paragraph 17 and advise us as soon as possible. We aim to resolve all complaints within 30 days. If your complaint is complex or requires more time, we will inform you of the status of your complaint and an expected resolution timeframe. If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC). 
     
    14.2 It would assist us to respond to your complaint promptly if it is made in writing through email at

14.3 We will notify you of the outcome of our investigation. 
 
15. Notifiable Data Breaches 

15.1 English with Jumping Jinx takes the security of your personal information seriously. In the event of a data breach involving personal information, English with Jumping Jinx will assess whether the breach is likely to result in serious harm to any individual, in accordance with the requirements of the Notifiable Data Breaches (NDB) scheme under the Privacy Act 1988 (Cth). 

15.2 Where a breach is likely to result in serious harm, English with Jumping Jinx will promptly notify: 

  • the affected individuals, and 

  • the Office of the Australian Information Commissioner (OAIC), 

including details of the breach, the kind of information involved, and recommended steps individuals should take in response. 

15.3 English with Jumping Jinx has a Data Breach Response Plan that sets out how we detect, contain, investigate and respond to data breaches. Our Managing Director leads the response process and ensures timely assessment and notification where required. 

15.4 If you suspect that your personal information has been involved in a data breach connected with English with Jumping Jinx, please contact our Managing Director immediately using the contact details in section 17 below. 

16. Updates to this Privacy Policy

16.1 We may, from time to time, review and update this Privacy Policy, including to take into account new laws, regulations, practices and technology. All Personal Information held by us will be governed by our most recent Privacy Policy, posted on our Website stated in section 5 where the Privacy Policy will be located. Any changes to this Privacy Policy may be advised to you by updating this page on our Website. We will aim to provide reasonable advance notice of such changes though this may not always be possible depending on the circumstances. We encourage you to check this page from time to time for any changes.

Terms and Conditions

These Terms & Conditions govern all enrolments and subscriptions with English with Jumping Jinx (ABN 18743891399.) By completing an enrolment, you agree to be bound by these terms. The specific fees for our courses and current service offerings are set out in English with Jumping Jinx.

1.  Enrolment & eligibility

To complete your enrolment with English with Jumping Jinx (“English with Jumping Jinx” or “We”), you must be 15 years of age or older in Australia. If you are under 15 years of age in Australia and under 13 years in USA, UK and Europe, a parent or legal guardian must complete the enrolment on your behalf. In that case, both the student and the parent or legal guardian must ensure compliance with these Terms. Throughout these Terms, “you” and “your” refer to the student and, where applicable, the parent or legal guardian.

You must provide accurate and complete information at enrolment. English with Jumping Jinx reserves the right to suspend or cancel an enrolment where information provided is found to be false or misleading.

2.  Our service commitments

2.1 What English with Jumping Jinx will provide

English with Jumping Jinx will provide you with an online learning program (“Service”) that may be varied from time to time to support your academic and educational needs. The Service includes:

  • an adaptive learning plan incorporating a course or program of learning;

  • allocation of an English with Jumping Jinx tutor or tutors matched to your needs;

  • access to the English with Jumping Jinx learning platform and content specifically designed to meet your learning objectives;

  • an ongoing program of live online classes with a tutor (“Class or classes”);

  • a guideline of learning goals and the provision of feedback and reporting at the end of each course.

English with Jumping Jinx will:

  • maintain the confidentiality of your personal information, academic performance, and use of the English with Jumping Jinx platform, subject to the consents set out in these Terms;

  • notify you of any changes to fees charged for its services. You are under no obligation to accept fee changes and may cancel your enrolment if you elect not to accept them. Current pricing is published on the English with Jumping Jinx Website.

2.2 Student obligations

You must:

  • have access to a computer with a current browser, a camera, a microphone, and reasonable internet access 

  • it is the student’s responsibility to make sure that they have a reliable and secure computer, phone or tablet with internet sufficiency. Where technical issues are detected, English with Jumping Jinx will work with our third part providers such as Zoom, Google Meets and our Website platform to help you resolve the issue;

  • attend classes  for each month

  • use your best endeavours to complete any practice work (“Happy homework”) set between Classes;

  • pay for the Service in accordance with the pricing and plan rules published on our Website

  • communicate with your English with Jumping Jinx tutor only through the English with Jumping Jinx platform and its communication systems;

  • comply with English with Jumping Jinx’s policies and procedures as updated from time to time, including consenting to English with Jumping Jinx:

    • recording and reviewing each Class for quality assurance, internal training, and your own review;

    • recording all class and platform data for the purposes of diagnosing your proficiency and learning requirements, assessing and reporting on academic performance and progress and use in educational research.

  • respect English with Jumping Jinx’s intellectual property: the learning content and homework on the English with Jumping Jinx platform is licensed to you personally and must not be shared with or provided to any third party.

3.  Payments & billing

Payments for Classes are paid for by you when you purchase a course through the English with Jumping Jinx’s Website.

A credit card surcharge may apply, calculated as a percentage of the transaction amount. Current surcharge rates are published on our Website and are not greater than English with Jumping Jinx’s cost of acceptance. Credit card surcharges are not refundable.

4.  Cancellation and enrolment changes

4.1  Rescheduling

Rescheduling classes is not necessary as students can access up to 16 lessons per month for no additional cost and if a child misses a lesson they can join any other class that month.

4.2 Cancellation of individual Classes 

Any paid individual class that is not attended by the student will not be re-scheduled or refunded. Cancelling a Class will result in forfeiture of that Class fee. Where a Class is affected by a service failure on English with Jumping Jinx’s part (refer to clause 5.4), English with Jumping Jinx will compensate you by offering a replacement class. Unattended classes are not eligible for a refund or credit except as required by the Australian Consumer Law.

5.  Refunds & Australian Consumer Law rights

5.1 Your ACL rights

The Australian Consumer Law (“ACL”) sets out consumer guarantees that apply to the tutoring services provided by English with Jumping Jinx. These include that English with Jumping Jinx’s services will be:

  • provided with acceptable care, skill, and technical knowledge;

  • fit for the purpose agreed between English with Jumping Jinx and you; and

  • delivered within a reasonable time of the scheduled 16 classes per month.

 Nothing in these Terms limits or excludes any rights you have under the ACL that cannot lawfully be excluded.

5.2 Remedy for service failure

Where there is a ‘major failure’ of the service guarantees (as defined under the ACL), you are entitled to a full refund if you request one. A major failure occurs where the service:

  • has a problem that would have stopped you from acquiring it had you known about it;

  • is substantially unfit for its purpose and cannot easily be fixed within a reasonable time; or

  • does not meet the specific purpose agreed and cannot easily be fixed within a reasonable time.

 Where the failure is not a major failure but is still a material failure on English with Jumping Jinx’s part, English with Jumping Jinx’s standard remedy is offer a free individual 50 minute class for the student.  Monetary credits and refunds remain available where required by the ACL or where English with Jumping Jinx, in its discretion, considers them appropriate on a case-by-case basis.

5.3 Refunds on cancellation

If your English with Jumping Jinx account is cancelled by you there will be no refund. 

Credit card surcharges paid at the time of a transaction are non-refundable.

5.4 How to request a refund or credit

To request a credit or refund, please contact English with Jumping Jinx by emailing hello@englishwithjumpingjinx.com . Where the request relates to a service failure, English with Jumping Jinx will respond to all requests in accordance with its internal compensation governance framework.

6. Content ownership 

All content, including but not limited to video lessons, mock exams, assessments, and learning resources available through English with Jumping Jinx, is the intellectual property of English with Jumping Jinx or its licensors and is licensed to you for personal educational use only. Content may not be copied, shared, published, or distributed without English with Jumping Jinx’s prior written consent. Downloadable resources are for the enrolled students’ use only and may not be redistributed.

You retain ownership of any original content you submit or upload to English with Jumping Jinx (including questions, answers, homework, essays, assignments, and other materials) ("User Content"). By submitting User Content, you grant English with Jumping Jinx a worldwide, royalty-free, non-exclusive, sublicensable licence to host, store, reproduce, modify, create derivative works from, and use that User Content for the purposes of operating, providing, improving, and developing the English with Jumping Jinx platform and related services, including training and refining English with Jumping Jinx's Website and/or learning systems. This licence continues for as long as is reasonably necessary for those purposes and survives termination of your subscription.

7. Service updates, suspension and customer support

7.1 Service changes and suspension

English with Jumping Jinx may update, expand, or discontinue features of English with Jumping Jinx’s courses at any time. English with Jumping Jinx will provide reasonable notice of material changes. Access to English with Jumping Jinx may be suspended or terminated for non-payment, misuse, or breach of these Terms.

7.2. Support and disputes

Support for English with Jumping Jinx’s classes is available by emailing us at hello@englishwithjumpingjinx.com. In the event of a concern or dispute, you are encouraged to contact English with Jumping Jinx to resolve the matter informally in the first instance. If resolution is not reached, the matter will be escalated in accordance with English with Jumping Jinx’s internal dispute resolution procedures and, where applicable, the governing law provisions in clause 9.3.

8.  Privacy, data & intellectual property

English with Jumping Jinx will maintain the confidentiality of your personal information and academic data in accordance with its Privacy Policy, available at https://english withjumpingjinx.com. By enrolling, you consent to English with Jumping Jinx recording each Class and all platform data for the purposes described in clause 2.2.

All learning content hosted on the English with Jumping Jinx platform is the intellectual property of English with Jumping Jinx or its licensors. The content is licensed to you personally for the purposes of your enrolment only. You must not reproduce, share, or provide access to any content to third parties.

9.  Liability, variation & governing law

9.1 Results & liability

The results of using English with Jumping Jinx’s services may vary and depend on a range of factors personal to each student. English with Jumping Jinx does not guarantee that use of the Service will lead to an improvement in academic performance or results.

To the full extent permitted by law, English with Jumping Jinx’s liability to you is limited to the resupply of the affected service or, at English with Jumping Jinx’s election, the payment of the cost of having the service resupplied. English with Jumping Jinx will not be responsible for indirect, consequential, or economic losses. Nothing in this clause limits your rights under the ACL.

9.2 Variation

English with Jumping Jinx may, acting reasonably, vary these Terms and conditions and any other referenced policies or Website information from time to time. Where English with Jumping Jinx varies these Terms in a way that materially affects your rights, English with Jumping Jinx will provide reasonable notice. The fees and plan details may be updated more frequently, with changes effective from the date of publication or such notice period as English with Jumping Jinx specifies. Your continued enrolment after the effective date of a change constitutes acceptance of the updated terms. You may cancel your enrolment in accordance with clause 4.4 if you do not accept a material change.

9.3 Governing law

These Terms are governed by the laws of the State of New South Wales, Australia. Any dispute arising in relation to these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales. 



English with Jumping Jinx subscription fees

Effective 1 July 2025. All Amounts in AUD

Our class subscription fees form part of the English with Jumping Jinx Terms & Conditions and are incorporated into every enrolment. It sets out current subscription fees for group lessons, our introductory offer and individual lessons. It may be updated from time to time in accordance with the variation provisions of the Terms & Conditions.

A credit card surcharge may apply. Payments are processed by direct debit or credit card. You must ensure your payment method is still valid and secure.

Service recovery procedure

Where a material service failure occurs, English with Jumping Jinx’s standard remedy is to allow students to join any other class.

Credit card surcharges

A credit card surcharge may apply to cover English with Jumping Jinx’s cost of accepting certain card types. Surcharges are calculated as a percentage of the transaction amount plus a fee and are not greater than English with Jumping Jinx’s cost of acceptance. Current rates vary depending on the merchant. They vary between 1.2% to 4.1% plus a 0.30 cent charge. Australian and international fees are different. 

Credit card surcharges are not refundable.

Subscription fee

The current English with Jumping Jinx monthly subscription fee is published on the English with Jumping Jinx Website. English with Jumping Jinx may adjust the English with Jumping Jinx pricing by providing 30 days’ notice. Bundled pricing and promotional rates for tutoring customers may be offered from time to time.

Cancellation 

English with Jumping Jinx subscriptions may be cancelled at any time through your online English with Jumping Jinx login portal. Billing ceases at the end of the current monthly billing period. No partial-month refunds apply unless required by the Australian Consumer Law. Cancellation of an English with Jumping Jinx subscription does not affect any active tutoring enrolment.

Access & eligibility

English with Jumping Jinx is currently available to English with Jumping Jinx enrolled subscription students. A valid student profile is required to activate English with Jumping Jinx. Access features and content availability vary by the product purchased and may change from time to time and as new features are released.

Notice periods & cancellation 

To cancel your subscription, you can cancel at any time by logging into your account and cancelling. The cancellation will take effect prior to the next billing cycle.
